Welcome to ProFlight Rentals. These Terms of Service ("Terms") govern your use of the ProFlight Rentals mobile application and services ("Service"). By creating an account or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using ProFlight Rentals, you confirm that you are at least 18 years old and agree to comply with these Terms. If you do not agree, please do not use our Service.

2. Account Registration

To use ProFlight Rentals, you must create an account by providing your name, email address, and phone number. You agree to:

  • Provide accurate and complete information
  • Keep your account information up to date
  • Maintain the security of your account credentials
  • Accept responsibility for all activity under your account

3. SMS/Text Messaging Consent

By providing your phone number during registration, you expressly consent to receive SMS text messages from ProFlight Rentals for the following purposes:

  • Account Verification: One-time passcodes (OTP) to verify your identity when logging in or creating your account
  • Rental Receipts: Transaction notifications sent after you return rented equipment, including your total charge and a link to view the full receipt

Message frequency varies based on your use of the Service. Standard message and data rates may apply. You may opt out of SMS messages at any time by replying STOP to any message. Note that opting out may affect your ability to log in, as we use SMS-based verification for authentication. For help, reply HELP or contact support@proflightrentals.com.

4. Equipment Rental

ProFlight Rentals provides sports equipment for temporary rental. When renting equipment, you agree to:

  • Use equipment only for its intended purpose
  • Return equipment in the same condition as received (normal wear excepted)
  • Return equipment by the agreed-upon time
  • Pay all applicable rental fees, late fees, and damage charges
  • Not sublease, loan, or transfer rented equipment to others

5. Fees and Payment

Rental fees are displayed in the app before you confirm a rental. By completing a rental, you authorize ProFlight Rentals to charge your payment method for:

  • The rental fee for the selected equipment and duration
  • Any applicable taxes
  • Late fees if equipment is returned after the rental period
  • Damage or replacement costs if equipment is returned damaged or not returned

6. Liability and Assumption of Risk

Sports activities involve inherent risks. By renting equipment through ProFlight Rentals, you acknowledge and assume all risks associated with using the rented equipment. ProFlight Rentals is not liable for any injury, damage, or loss arising from the use or misuse of rented equipment.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Provide false or misleading information
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use equipment in a manner that damages or destroys it

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may also delete your account at any time by contacting support@proflightrentals.com.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the fullest extent permitted by law, ProFlight Rentals shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

11. Changes to Terms

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.
